<p dir="ltr">В Приморском районном суде Санкт-Петербурга продолжается рассмотрение так называемого уголовного дела "Лайф-из-Гуд" &mdash; "Гермес" &mdash; "Бест Вей" &mdash; продолжается допрос признанных следствием потерпевшими и свидетелей обвинения.</p><p>&nbsp;</p><p dir="ltr">Например, на одном из летних заседаний выступал некто Голубев &mdash; водитель из Удмуртии, который был пайщиком кооператива и клиентом компании "Гермес". Как рассказали протоколирующие заседания адвокаты, Голубев сообщил, что еще до событий начала 2022 года &mdash; активной фазы расследования уголовного дела, вышел из компании "Гермес", а также написал нотариально заверенное заявление о выходе из кооператива "Бест Вей". Из "Гермеса" получил через деньги через схему p2p &mdash; так, мол, консультант "Гермеса" ему рекомендовал, "чтобы не платить комиссию". При выводе средств Голубев получил больше, чем ранее положил на счет.</p><p>&nbsp;</p><p dir="ltr">Голубев решил выйти также из кооператива, так как написал заявление &mdash; но деньги получил из-за ареста счетов только в этом году. Предъявляет претензии к тому, что денег пришлось ждать три года, хотя они не выплачивались из-за ареста счетов и позиции следствия и прокуратуры, состоящей в том, что выплаты должны быть запрещены даже пайщикам, выходящим из кооператива: арест счета &mdash; не препятствие для таких выплат, если оно санкционировано следствием и прокуратурой. Голубев при этом требует вернуть вступительный и членские взносы, так как "кооператив нарушил условия соглашения". При этом изначально ему был присвоен статус потерпевшего, в суде же он выступал уже в статусе свидетеля.</p><p>&nbsp;</p><p dir="ltr">Таких "потерпевших", как Голубев, немало, отмечают адвокаты: так, одна из пайщиц на недавнем заседании обвинила кооператив в том, что он ей не выплатил средства по заявлению о выходе, в то время как она сама систематически отказывается подтвердить реквизиты для перечисления средств, получает письма из кооператива, отправляет уведомления о прочтении, но не отвечает на них.</p><p>&nbsp;</p><p dir="ltr">Состоялось долгожданное разбирательство по апелляционному представлению Прокуратуры Санкт-Петербурга на решение Приморского районного суда Санкт-Петербурга полностью снять арест с одного из трех счетов кооператива, на которых почти 4 млрд рублей.</p><p>&nbsp;</p><p dir="ltr">Сейчас кооператив распоряжается только вновь поступившими на эти счета средствами &mdash; за счет этих средств происходят выплаты пайщикам, написавшим заявление о выходе из кооператива, при этом темп выплат крайне низкий из-за проверок каждого платежа Росфинмониторингом и банками. Кроме того, по решению суда происходят выплаты с арестованных средств по исполнительным листам тем пайщикам, кто решил не ждать выплат, а предъявил и выиграл иски к кооперативу о возврате средств, а также налогов кооператива и зарплаты его персоналу.</p><p>&nbsp;</p><p dir="ltr">Кооператив ходатайствовал перед судом о полном снятии ареста с одного из счетов кооператива &mdash; самых маленьких, в банке ПСБ, на более чем 600 млн рублей, чтобы гарантированно рассчитаться со всеми примерно 2000 пайщиков, которые подали заявление о выходе из кооператива, &mdash; не зависеть от возвратных платежей в кооператив, которые из-за ареста счетов были затруднены и сейчас осуществляются с задержками &mdash; с которыми кооператив борется, но быстро эти платежи в нужном объеме вряд ли сможет получить.</p><p>&nbsp;</p><p dir="ltr">Решение суда первой инстанции о снятии ареста было в апреле, назначение рассмотрения апелляции в Санкт-Петербургском городском суде крайне затянулось из-за того, что прокуратура добавила к основному апелляционному представлению дополнительное &mdash; рассмотрение состоялось только в начале июля.</p><p>&nbsp;</p><p dir="ltr">При этом уже в самом заседании прокуратура добавила новые доводы, заявив, что в реестре выплат, представленном кооперативом еще в начале 2025 года, из 773 строк по пайщикам, которым произведены выплаты, имеются 14 строк, в которых фигурирует один из подсудимых &mdash; Выдрин, а также 13 лиц, которые назывались лицами, признанными потерпевшими, в рамках уголовного процесса как лица, которым передавались деньги для компании "Гермес". Прокуратуру возмутило то, что лица, которые, возможно, виновны в хищениях, получили средства раньше лиц, признанных потерпевшими. При этом Выдрин написал заявление о выходе из кооператива еще до того, как был привлечен в уголовное дело, и ни на какие его активы арест не накладывался.</p><p>&nbsp;</p><p dir="ltr">Санкт-Петербургский городской суд согласился с доводами прокуратуры, отменив решение суда первой инстанции в части снятия ареста со счета &mdash; при этом он не подверг сомнению тезис, на котором было основано это решение Приморского районного суда: несоразмерность общей суммы ущерба в уголовном деле &mdash; 282 млн рублей и общей суммы арестованных средств только кооператива как гражданского ответчика по данному уголовному делу &mdash; почти 4 млрд рублей (при этом есть еще аресты средств других лиц).</p><p>&nbsp;</p><p dir="ltr">В самом конце июля Приморским районным судом будет уже рассматриваться продление или непродление арестов средств на счетах на новый трехмесячный срок &mdash; и кооператив опять будет ходатайствовать о снятии ареста со счета в банке ПСБ.</p><p>&nbsp;</p><p dir="ltr">В Приморском районном суде началось также новое гражданское дело &mdash; по иску пайщицы кооператива Дорониной к пайщику кооператива, объявляющему себя его альтернативным председателем, Георгию Моисееву, ранее активисту кооператива и координатору программы по проведению региональных митингов в поддержку кооператива. Судебное разбирательство по существу начнется в сентябре, судья потребовал от представителей Моисеева представить первичные документы о якобы проведенном (без решения совета кооператива) голосовании по выборам новых уполномоченных, так как его юрист сообщил, что документы &mdash; на кооперативных участках.</p><p>&nbsp;</p><p dir="ltr">Председателям самочинных комиссий по перевыборам, якобы прошедшим весной на 13 из 14 кооперативных участков, придется представить первичные документы, бюллетени для голосования, при этом общее число голосовавших должно быть не менее 7,5 тыс., так как в кооперативе &mdash; 15 тыс. пайщиков. (На одном из участков &mdash; кооперативном участке (КУ) № 7: иркутско-бурятско-забайкальском &mdash; группа Моисеева проводить голосование не решилась, так как еще в начале года одна из пайщиц подала против Моисеева иск о незаконных действиях в иркутский суд, который сейчас активно рассматривается.)</p><p>&nbsp;</p><p dir="ltr">В суд с первичными документами, как подчеркивают адвокаты, придется явиться председателям "комиссий по проведению голосований на кооперативных участках":</p><p>&nbsp;</p><p dir="ltr">на КУ № 1 &mdash; Атрохиной Н. When President Donald Trump reopened a long-closed conversation about the name of the Washington NFL team, he and others implied that liberal thinking forced the venerable franchise to change its name from Redskins to Commanders in 2022.

It wasn’t “wokeness” that led to that moment. It was capitalism. Corporate sponsors made the decision, not politicians or fans.

On July 2, 2020, after the murder of George Floyd in late May and the resulting national conversation on race and racism, FedEx – the title sponsor of the team’s stadium at the time – called on the franchise to change its name.

Nike removed Redskins apparel from its website on the same day. The next day, the league and the organization announced that they were reviewing the team’s name. Soon, Amazon, Target and Walmart also removed Redskins merchandise from their stores and websites.

At a time of heightened corporate sensitivity to racism, the franchise suddenly saw the possibility of millions of dollars in revenue being lost due to the Redskins name. After years of controversy, the organization’s then-leadership finally saw the financial writing on the wall and gave up a fight they had promised to wage forever.

On July 13, the team announced it was retiring its name and logo and would go by the name Washington Football Team for the time being. Less than two years later, after a contest to rename the team, it became the Commanders.

None of this came about quickly, or without a fight. This was a conversation, and a decision, years in the making. Protests occasionally popped up around Washington Redskins games in the 1990s and early part of the 21st century, but there was no evidence of a groundswell to change the name.

In 2013, the National Congress of American Indians, representing 1.2 million people in its member tribes, announced that it opposed the moniker.

The team consistently replied by saying it was honoring the achievements of Native Americans by keeping the name. As evidence, then-team president Bruce Allen said that three high schools with a majority Native American student body used the name. The team and its supporters mentioned a 2004 poll by the Annenberg Public Policy Center that found that a majority of Native Americans were not offended by the name.

Then again, the use of public polling methods to measure a small, diverse population also came into question and was criticized by experts.

More than a decade ago, Sports Illustrated’s Peter King led the way, as did a few other sports journalists, including myself, publicly stating that we would no longer use the name – a name that each of us had said thousands of times in our careers covering the NFL.

“Try explaining and defending the nickname to a child,” I wrote in 2013. “It’s impossible.”

Back then, NFL commissioner Roger Goodell was still defending the team’s name, but he said in radio interviews that he wanted to “listen” on the issue.

“We’ll always listen, and we’ll always be open,” he said on ESPN Radio August 1, 2013, when asked to compare his defense of the Washington team name with his comments on Philadelphia Eagle Riley Cooper’s racist slur at the time, which were anything but a defense: “Obviously wrong … insensitive and unacceptable,” Goodell said of Cooper’s language.

Goodell went farther a month later while speaking to a Washington radio station: “Ultimately it is Dan (Snyder’s) decision, but it is something I want all of us to go out and make sure we are listening to our fans, listening to people that have a different view, and making sure we continue to do what is right. We want to make sure the team represents the strong tradition and history that it has for so many years. … If we are offending one person we need to be listening and making sure we are doing the right things to address that.”

The Department of Justice quickly fired the newly named US attorney in New Jersey on Tuesday after federal judges in the state declined to extend Alina Habba’s interim appointment.

Attorney General Pam Bondi’s announcement came after the district court voted to elevate Desiree Leigh Grace, New Jersey’s first assistant US attorney, to replace the Trump ally.

Accordingly, the First Assistant United States Attorney in New Jersey has just been removed. The rapid change-up prompted confusion as to who will lead the top federal prosecutor’s office in the state.

It’s unclear if Grace’s removal is enforceable or whether the district court judges will challenge the move. There’s also some confusion of when Habba’s appointment expires.

Grace’s appointment was set to be “effective July 22, 2025, or ‘upon the expiration of 120 days after appointment by the Attorney General’ of the Interim U.S. Attorney Alina Habba, whichever is later,” according to the order signed by Chief Judge Renee Marie Bumb.

President Donald Trump appointed Habba to the position on March 24, but she was sworn in on March 28, with department officials arguing that her term doesn’t conclude until Friday. Interim US attorneys are only allowed to serve for 120 days if they are not confirmed by the US Senate or extended indefinitely by the district court in their jurisdiction.

Habba previously served as a spokesperson for the Trump campaign and as a personal attorney for Trump. She represented Trump during his civil fraud trial in 2023 and 2024. After Trump won reelection, Habba served as counselor to the president before Trump tapped her to serve as US attorney.

Trump formally nominated Habba to serve in the position for a four-year term on July 1. Habba’s nomination is still awaiting a vote from the Senate Judiciary Committee before she would advance to the full Senate for a floor confirmation vote.

The president and his legal team have been exploring options for reappointing nominees rejected by the courts, but it is unclear if Habba would accept a reappointment in this case, according to two sources familiar with the matter.
Deputy Attorney General Todd Blanche put out a statement on X on Tuesday, saying: “The district court judges in NJ are trying to force out @USAttyHabba before her term expires at 11:59 p.m. Friday.”

“Their rush reveals what this was always about: a left-wing agenda, not the rule of law. When judges act like activists, they undermine confidence in our justice system. Alina is President Trump’s choice to lead—and no partisan bench can override that.”

He had previously urged the federal judges in New Jersey to appoint Habba indefinitely on an interim basis while she awaits Senate confirmation, saying she has the “full confidence” of leadership at the Justice Department.

Habba is President Trump’s second US attorney nominee to struggle to receive support from the district court or the Senate Judiciary Committee. In May, the Senate Judiciary Committee decided not to confirm Trump’s controversial pick to lead the DC US attorney’s office, Ed Martin.
